Terms of Service

Welcome to Fotario Photo Editor. These Terms of Service ("Terms") govern your use of the Fotario mobile application and services provided by AeroByte Studios ("we," "us," or "our"). By downloading or using the app, you agree to these Terms.

1. USE OF THE SERVICE

We grant you a personal, non-exclusive, non-transferable, revocable license to use Fotario for your personal, non-commercial use on a mobile device that you own or control.

You agree not to:

  • Reverse engineer, decompile, or attempt to extract the source code of the app.
  • Use the app for any illegal or unauthorized purpose.
  • Modify, adapt, or create derivative works based on the app's proprietary shaders, filters, or source code.
  • Circumvent or disable any security features or in-app purchase mechanisms.

2. USER CONTENT & LOCAL PROCESSING

You retain full ownership of all photos, designs, and content you create or edit using Fotario. We do not claim ownership of your content.

Fotario processes your images locally on your device. We are not responsible for the loss of edits, drafts, or photos if you uninstall the app or clear your device storage. We strongly recommend saving your final edits to your device's gallery.

3. IN-APP PURCHASES & SUBSCRIPTIONS (Fotario PRO)

Fotario offers "PRO" features that can be purchased as a recurring subscription or a one-time payment. By purchasing a subscription, you agree to the following terms:

  • Billing & Renewal: Payment will be charged to your Apple App Store or Google Play Store account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period.
  • Account Charges: Your account will be charged for renewal within 24 hours prior to the end of the current period at the original subscription price.
  • Managing Subscriptions: You can manage your subscriptions and turn off auto-renewal by going to your Account Settings on the App Store or Play Store after purchase. We cannot cancel subscriptions on your behalf.
  • Free Trials: Any unused portion of a free trial period, if offered, will be forfeited when you purchase a premium subscription.
  • Refunds: All refund requests must be handled directly through Apple or Google according to their respective store policies. AeroByte Studios cannot issue direct refunds.

4. INTELLECTUAL PROPERTY

The Fotario app, including its original content, features, filters, UI design, vector shapes, stickers, and branding, are the exclusive property of AeroByte Studios and are protected by copyright and trademark laws. You may use the provided assets (stickers, fonts, backgrounds) solely for creating your personal or commercial edits within the app, but you may not extract and redistribute these assets individually.

5. DYNAMIC CONTENT & UPDATES

We may update the app or dynamically change in-app content (such as available filters, stickers, and promotional banners) at any time without prior notice to improve the user experience.

6. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AEROBYTE STUDIOS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, OR ANY LOSS OF DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE APP.

7. DISCLAIMER OF WARRANTIES

YOUR USE OF THE SERVICE IS AT YOUR SOLE RISK. THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.

8. GOVERNING LAW

These Terms shall be governed and construed in accordance with the laws of the jurisdiction where AeroByte Studios is registered, without regard to its conflict of law provisions.

9. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will provide notice of any material changes by updating the date at the top of these Terms. Your continued use of Fotario after such changes constitutes your acceptance of the new Terms.
